The rules that govern your use of AsbestosExposure.ca. Please read them before using the site.

1. Who these terms are between
These Terms of Service ("Terms") are a legal agreement between you ("you") and AsbestosExposure.ca ("we," "us," "our"), the operator of the website at https://www.asbestosexposure.ca (the "Site"). By accessing or using the Site, submitting a form on the Site, or otherwise communicating with us through the Site, you agree to these Terms. If you do not agree, do not use the Site.
2. What the Site is, and what it is not
AsbestosExposure.ca is an independent Canadian information resource that publishes plain-language content about asbestos exposure, asbestos-related disease, workers' compensation, and how to find a lawyer who handles asbestos and mesothelioma claims.
We are not a law firm. We do not provide legal services, legal advice, or legal opinions. We do not represent clients. Reading the Site or submitting a form on the Site does not create a lawyer-client relationship between you and us or between you and any lawyer advertised on the Site. A lawyer-client relationship can only be formed by a written retainer with a lawyer.
We are not medical professionals. Nothing on the Site is medical advice, diagnosis, or treatment. See a physician about symptoms, testing, or a diagnosis.
3. Eligibility
You must be at least 18 years old (or the age of majority in your province or territory of residence, whichever is higher) to use the Site or submit any form. The Site is intended for residents of Canada; if you access it from another country, you do so on your own initiative and are responsible for compliance with local laws.
4. Information on the Site
We try to keep the Site accurate and up to date. Every content page shows a "last reviewed" date and links to primary sources. Even so:
- Laws, benefit schedules, trust-fund payment percentages, and medical guidance change.
- Statements on the Site are general information and do not account for your specific circumstances.
- We are not responsible for outcomes, decisions, or actions taken in reliance on the Site. See our disclaimer for the full statement.
5. Lawyer referrals
If you consent through our questionnaire, we may share your information with an independent Canadian law firm in our advertising network so that firm can contact you for an initial consultation. That firm is independent of us. We do not employ, supervise, or share fees with any lawyer.
- You are never obligated to retain a lawyer we introduce.
- Any lawyer-client relationship is between you and the lawyer, on terms you agree with them.
- We receive advertising fees from law firms, structured as advertising and not as a share of any legal recovery. See How we make money.
- Complaints about a specific lawyer or law firm should be directed to the law society in that firm's province. Complaints about the Site or a referral experience can be sent to info@asbestosexposure.ca.
6. Your submissions
When you send us information through a form, email, or other means, you confirm that:
- The information you provide is true and complete to the best of your knowledge.
- You have the right to share the information (including any information about others).
- You consent to our handling of the information as described in our Privacy Policy, including sharing your questionnaire information with a law firm in our network if you have opted in.
You grant us a non-exclusive, worldwide, royalty-free licence to use the information you submit only for the purposes described in our Privacy Policy. We will not sell your information.
7. Acceptable use
You agree not to:
- Use the Site to submit false, misleading, defamatory, or unlawful content.
- Impersonate any person or misrepresent your relationship to another person whose information you submit.
- Attempt to interfere with, disable, or reverse-engineer any part of the Site.
- Use automated tools (bots, scrapers) to collect information from the Site without our written consent.
- Use the Site in a way that violates applicable law or the rights of any person.
8. Intellectual property
All content on the Site, text, layout, graphics, structure, and code, is owned by us or our licensors and is protected by Canadian and international copyright and trademark law. You may view and print pages for personal, non-commercial use. Any other reproduction, republication, or commercial use requires our prior written permission.
You may link to the Site's public pages using accurate descriptions and without implying any affiliation, endorsement, or sponsorship that does not exist.
9. Third-party content and links
The Site links to third-party websites (workers' compensation boards, medical bodies, government resources, law firms, testing labs, and others). We do not control third-party sites and are not responsible for their content, practices, or policies. Following a third-party link is at your own risk.
Some links on the Site are advertising or affiliate links. Where we receive compensation for a link, we disclose that on the page or in the relevant section. See How we make money.
10. Disclaimer of warranties
The Site and all information on it are provided "as is" and "as available," without any warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability. We do not warrant that the Site will be secure or error-free, that any information will be current, or that any lawyer, contractor, or lab we mention will meet your needs.
11. Limitation of liability
To the maximum extent permitted by applicable law:
- We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site, including lost profits, lost opportunities, lost data, or loss of goodwill, even if we have been advised of the possibility of those damages.
- Our total aggregate liability to you for all claims arising out of or related to the Site is limited to the greater of (a) one hundred Canadian dollars (CAD $100), or (b) the amounts, if any, you have paid to us in the twelve months preceding the claim.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for fraud or for personal injury caused by our negligence to the extent Canadian law does not allow it to be limited).
12. Indemnity
You agree to indemnify, defend, and hold harmless AsbestosExposure.ca and its operator, officers, and contractors from and against any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Site;
- Any information you submit through the Site;
- Your breach of these Terms; or
- Your violation of any law or the rights of any third party.
13. Modifications
We may change the Site or these Terms at any time. When we make material changes to these Terms, we update the "Effective date" above and, where practical, post a notice on the Site. Your continued use of the Site after a change means you accept the updated Terms.
14. Suspension and termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if we discontinue any feature. Sections that by their nature should survive termination will survive (including Sections 8, 10, 11, 12, and 15).
15. Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in that province (or, if the operator relocates, the laws of the operator's home province at the time of the dispute), without regard to conflict-of-law rules. The parties submit to the exclusive jurisdiction of the courts of that province, subject to any right you have under consumer- protection law in your own province.
Site operator: fill in the governing province above once your registered business address is confirmed; default set to British Columbia pending confirmation.
16. Complaints and contact
If you have a complaint about the Site, a piece of content, or a referral, please contact us first at info@asbestosexposure.ca. We will acknowledge within 2 business days and respond substantively within 15 business days.
You may also complain to the Office of the Privacy Commissioner of Canada if you believe we have mishandled personal information, see our Privacy Policy for details.
17. Severability and entire agreement
If any part of these Terms is held to be invalid or unenforceable, the remaining parts continue in effect. These Terms, together with our Privacy Policy, Disclaimer, and Editorial Policy, are the entire agreement between you and us regarding the Site and supersede any prior agreements on the subject.
